A Manhattan judge declared a mistrial Friday after jurors said they were unable to reach a verdict on whether Harvey Weinstein raped Jessica Mann, a year after another jury failed to make a decision.
The seven men and five women on the jury began deliberating Wednesday in Weinstein’s retrial on a third-degree rape charge tied to Mann’s allegations. Weinstein’s lawyers argued that the encounter was consensual.
Jurors sent a note saying they “have concluded that they cannot reach” a unanimous verdict. Judge Curtis Farber instructed the group to continue deliberating.
But by about 1 p.m., jurors informed the court they remained hopelessly deadlocked. Farber then declared a mistrial.
