Buyer threatening a small claims case against me after car deal. Location: Texas I sold my car to a private buyer which had a loan on it. We did it all through his bank in order for him to refinance the car through his bank. There was an overage from the payoff amount and my asking price, so i was planning on putting that towards my next car as i’m transferring to University and needed something more efficient. I wasn’t sure about the status of the car, it had remained accident free through my ownership, and i couldn’t account for previous accidents so i bought a VinCheckup report. I sent this report to the buyer through text where it had stated it was a clean title with no accidents. He said it looked good and that he’d like to meet up so we could make a deal. The car was under my dads name, but i had paid the note, insurance, and maintained the car for the duration we had it.
