My daughter is currently working with the SVD DAs office in Manhattan to prosecute her rapist. Dude racked up 9 felonies and 2 misdemeanors for rape, strangulation, suffocation, assault. The RFE and report are horrifying.
ADA says the next court date in a couple months is a “disposition” appearance, waiting on the opposing counsel to offer up a PPI. Not entirely sure what the PPI is — my impression is it’s a lengthy document arguing mitigating circumstances for an insultingly lenient plea deal.
Can anyone offer more details? is it a work product from the defendant’s counsel? is it something the office of probation provides? is it intended to have the DA tell the ADA it cant go to trial and just plea it out? is it designed to put a ceiling on how punitive a plea offer is? is it something that the judge can consider at her sole discretion when deciding whether or not to accept a plea?
